Terms of Use

1. Provider

ARTBOX.GROUPS GmbH, Schmidgasse 4, 6300 Zug, Switzerland (“ARTBOXY”), support@artboxy.com.

2. Scope

These terms apply to all photos and posters (“Content”) that you download from stock.artboxy.com. By downloading, you accept these terms.

3. Who may use the Content

The Content is available to artists who have taken part, or will take part, in the relevant ARTBOXY exhibition, fair or event.

4. What you may do

ARTBOXY grants you a free, non-exclusive and non-transferable right to use the Content for your own artistic presentation:

• on your own website,
• on your own social media channels,
• for press articles and media reports about you and your participation,
• for personal invitation cards to your exhibitions.

You may also use the posters to promote the relevant ARTBOXY exhibition.

5. No modifications

The Content may only be used unchanged. In particular, the following are not permitted:

• filters, changes to colour or brightness,
• retouching and montages,
• added text, logos, stickers or watermarks,
• editing with artificial intelligence.

Proportional downsizing and cropping of photos to common social media formats (e.g. 1:1, 4:5, 9:16) are permitted. The image content must not be distorted in the process.

Posters may be neither cropped nor altered. Dates, logos and texts must remain fully visible.

6. What is not permitted

• Producing and selling products featuring the Content, e.g. prints, posters, postcards, calendars, merchandise or digital products such as NFTs,
• advertising for third parties or for products and services unrelated to your art,
• passing on, selling or licensing the Content to third parties, including via image databases,
• using the Content to train AI systems,
• use in any context that disparages ARTBOXY, the photographers or the people depicted.

7. Credit

With every publication, you state the source visibly, e.g. in the caption or the post text: “Photo: ARTBOXY”. The attribution details in the file (photographer and copyright) must not be removed.

8. Third-party rights

The photos may show works by other artists as well as people. You may not use photos that mainly show the works of others as if they were your own. If a person depicted does not wish to be shown, you will remove the photo at our request.

9. Copyright

All rights in the Content remain with ARTBOXY or the respective photographer. You only receive the usage rights under section 4.

10. Revocation

ARTBOXY may revoke the right of use at any time, in particular in the event of a breach of these terms. In that case, you will remove the Content from all channels within 10 days.

11. Liability

The Content is provided without warranty. You are liable for any damage arising from use that breaches these terms, and you indemnify ARTBOXY against third-party claims.

12. Changes

ARTBOXY may amend these terms at any time. The version in force at the time of download applies.

13. Applicable law and place of jurisdiction

Swiss law applies exclusively. The place of jurisdiction is Zug.

14. Legally binding version

These terms are published in several languages. The German version is always the legally binding one. The translations are provided for easier understanding only.

15. Severability

If any provision of these terms is or becomes wholly or partly invalid or unenforceable, the validity of the remaining provisions is not affected. In place of the invalid provision, the valid arrangement that comes closest to the economic purpose of the invalid provision applies. The same applies to any gaps.
